La Suprema Corte de Justicia de la Nación (SCJN) resolvió ayer que la Ley General de Bibliotecas debe respetar los derechos de autor, por lo que las bibliotecas depositarias no podrán poner las obras y producciones para consulta pública sin la previa autorización de los titulares de los derechos de éstas, informó en un comunicado la Cámara Nacional de la Industria Editorial Mexicana (Caniem).
La segunda sala de la SCJN estudió dos amparos promovidos por más de 80 productores y autores de contenidos respecto a la Ley General de Bibliotecas, cuya reforma estipulaba que editoriales y productoras estaban obligados a entregar ejemplares digitales de todos sus materiales a las bibliotecas de México, Nacional y a la Cámara de Diputados.
“Los usuarios de las bibliotecas públicas harán uso de los servicios sin más límite que los establecidos por las disposiciones reglamentarias sobre consulta de acervos y visita pública. Los responsables de las bibliotecas públicas en ningún caso podrán condicionar el acceso a dichos servicios, con independencia del uso que cada usuario haga de la información a la que tenga acceso”, estipulaba la nueva norma.

SCJN, ResoluciónSin embargo, la SCJN señaló que “para efectos de consulta, puesta a disposición, copia o digitalización de las obras y publicaciones que se entregan en el Depósito Legal, la autoridad bibliotecaria debe sujetarse a las disposiciones aplicables de la Ley Federal del Derecho de Autor”.
Además indicó que “con previa autorización de los titulares de los derechos, las publicaciones y obras que conformen el depósito legal aludido pueden ser consultadas, puestas a disposición y, en su caso, digitalizadas únicamente para fines de conservación, con excepción de las publicaciones cuyos derechos hayan expirado o se ubiquen en las hipótesis de dominio público”.
La Caniem destacó que con esta resolución la SCJN otorga seguridad jurídica en la aplicación de la Ley General de Bibliotecas, “brindándole razón al sector creativo frente a los reclamos contra el impreciso texto de la Ley General de Bibliotecas publicado en un inicio”.
